TERMS & CONDITIONS
1. LICENCE AGREEMENT
1.1 This agreement grants the Customer a personal licence to use the allocated container for storage purposes only.
1.2 This agreement does not create a tenancy or lease and the Customer acknowledges that no security of tenure is granted.
1.3 ST IVES SECURE STORAGE reserves the right to relocate the Customer to an alternative container of similar size if reasonably required for operational, maintenance or security purposes.
2. USE OF CONTAINER
2.1 The container must only be used for lawful storage purposes.
2.2 The following are strictly prohibited:
- Sleeping or residing in the container
- Operating a business from the container without written permission
- Illegal or criminal activity
- Storage of stolen goods
- Flammable or explosive materials
- Firearms, weapons or ammunition
- Gas bottles or pressurised containers
- Chemicals, hazardous substances or toxic waste
- Food or perishable items
- Animals or living plants
- Cash, jewellery, precious metals or high-value collectibles
- Tyres, batteries, fuel or oils
- Waste materials
- Any item requiring specialist environmental conditions
2.3 ST IVES SECURE STORAGE reserves the right to refuse or remove prohibited items immediately.
3. ACCESS
3.1 Customers are provided with 24-hour access via keypad code.
3.2 Access codes remain the property of ST IVES SECURE STORAGE and may be changed at any time for security reasons.
3.3 Customers must not share access codes with any unauthorised person.
3.4 Customers are responsible for ensuring gates are closed and the container is secured after each visit.
3.5 ST IVES SECURE STORAGE reserves the right to temporarily restrict access for maintenance, emergencies, safety concerns or security incidents.
4. PAYMENT TERMS
4.1 Storage charges are payable monthly in advance.
4.2 Payment is due on the same calendar date each month as the agreement start date.
4.3 If payment is more than 7 days overdue, ST IVES SECURE STORAGE may:
- Deny site access
- Overlock the container
- Charge reasonable administration fees
- Recover debt collection costs
- Terminate this agreement
4.4 Any failed bank charges or payment processing fees may be charged to the Customer.
5. DEPOSIT
5.1 The deposit may be used towards:
- Unpaid rent
- Damage to containers, locks, gates or fencing
- Cleaning costs
- Disposal costs
- Lock replacement costs
- Any breach of this agreement
5.2 Deposits will normally be returned within 14 days of the agreement ending, subject to inspection and settlement of all outstanding sums.
6. MINIMUM HIRE PERIOD & TERMINATION
6.1 The minimum hire period is one month.
6.2 The Customer must provide a minimum of 30 days' written notice to terminate this agreement.
6.3 ST IVES SECURE STORAGE may terminate this agreement immediately if:
- Payments remain overdue
- The Customer breaches these terms
- Illegal or prohibited goods are discovered
- The Customer behaves abusively or dangerously on site
7. CUSTOMER RESPONSIBILITY & INSURANCE
7.1 All goods are stored entirely at the Customer's sole risk.
7.2 ST IVES SECURE STORAGE does not insure stored goods.
7.3 Customers are strongly advised to arrange their own insurance cover.
7.4 ST IVES SECURE STORAGE shall not be liable for loss or damage caused by:
- Theft
- Fire
- Flood
- Vermin
- Condensation
- Rust
- Mould
- Power failure
- Third-party actions
- Events outside reasonable control
7.5 Nothing within this agreement excludes liability for death or personal injury caused by negligence or any liability which cannot legally be excluded.
8. SECURITY
8.1 Customers are responsible for securing their own containers with a suitable lock unless otherwise agreed.
8.2 Lost keys, forgotten codes or lock removal requests may incur charges.
8.3 CCTV may operate throughout the site for crime prevention and security purposes.
9. RIGHT OF ENTRY
9.1 ST IVES SECURE STORAGE reserves the right to enter the container where reasonably necessary, including:
- Emergencies
- Fire or flood risk
- Suspected prohibited or illegal goods
- Non-payment
- Repairs or maintenance
- Requests from police or lawful authorities
10. DAMAGE
10.1 Customers are fully responsible for any damage caused by themselves, visitors or contractors to:
- Containers
- Gates
- Fences
- Surfacing
- Lighting
- Locks
- Security systems
- Any other site property
10.2 Repair costs shall be payable on demand.
11. NON-PAYMENT, ABANDONED GOODS & SALE OF ITEMS
11.1 If payments remain overdue for more than 28 days, ST IVES SECURE STORAGE may issue written notice requiring payment and/or collection of goods.
11.2 If the Customer fails to comply within 14 days of notice, ST IVES SECURE STORAGE may:
- Remove goods
- Dispose of goods
- Sell goods to recover outstanding sums and costs
11.3 Sale proceeds shall first be applied towards:
- Outstanding rent
- Administrative costs
- Debt recovery costs
- Removal and disposal costs
11.4 Any remaining balance may be returned to the Customer where reasonably practicable.
11.5 If sale proceeds are insufficient, the Customer remains liable for any shortfall.
12. CUSTOMER INFORMATION
12.1 Customers confirm all information supplied is accurate and up to date.
12.2 Customers must notify ST IVES SECURE STORAGE immediately of any changes to their address, telephone number or email address.
13. NOTICES
13.1 Any notice under this agreement may be served by:
- Email
- Text message or WhatsApp
- Post
- Hand delivery
13.2 Notices shall be deemed served using the latest contact details provided by the Customer.
14. GENERAL
14.1 Failure by ST IVES SECURE STORAGE to enforce any term shall not amount to a waiver of rights.
14.2 If any provision is found unenforceable, the remaining provisions shall continue in full force.
14.3 This agreement shall be governed by the laws of England and Wales.
